The U.S. Court of Appeals for the Ninth Circuit ordered the Environmental Protection Agency (EPA) to review the potential harm a toxic new fungicide poses to endangered species by June 22, 2023. The Center for Biological Diversity and the Center for Food Safety had appealed the EPA’s 2020 approval of the fungicide inpyrfluxam for some of the most widely grown U.S. crops. Plaintiffs presented evidence that the pesticide is “very highly toxic” to fish, including endangered salmon and steelhead, and poses substantial risks to large birds, including whooping cranes.
