The U.S. Fish & Wildlife Service (FWS) published notice of temporary, emergency, Endangered Species Act (ESA) listing status for the Dixie Valley toad, a small toad endemic to 760 acres of wetlands in Fallon, Nevada, which faces potential extinction due largely to geothermal development. The emergency listing is effective from April 7, 2022, through December 2, 2022, and FWS concurrently published notice of intent to classify the rare toad as endangered beyond the expiration date of the temporary rule. FWS is holding a virtual public meeting on the proposed listing on May 9, 2022, and is accepting public comments through June 6, 2022. The Bureau of Land Management is already facing potential ESA citizen suit litigation in connection with its approval of a geothermal construction project in Dixie Valley toad habitat.
