The United States Supreme Court granted the petition for writ of certiorari submitted by the National Pork Producers Council and the American Farm Bureau Federation in their lawsuit challenging the constitutionality of California’s Prop. 12, which prohibits confining mother pigs, calves used for veal, and egg-laying hens “in a cruel manner,” or selling products in California sourced from such animals not housed in accordance with the law’s minimum space and welfare standards. Plaintiffs appealed following numerous adverse decisions from lower courts that have upheld Prop. 12 and refused to enjoin its January 1, 2022, enforcement date. The U.S. Supreme Court will hear oral arguments in the fall of 2022.
