The U.S. Department of Justice, on behalf of the Department of the Interior, filed [pdf attached: Prairie Chicken Motion] an unopposed motion to consolidate two cases pending in the U.S. District Court for the Western District of Texas in which multiple states and livestock groups seek to vacate a U.S. Fish & Wildlife Service rule protecting two distinct populations of lesser prairie-chickens under the Endangered Species Act.
