A former Butterball poultry catcher filed a motion for reconsideration and for leave to file a third amended complaint after a North Carolina federal judge dismissed his North Carolina Wage and Hour Act claim which alleges that new evidence from former Butterball employees shows that the company failed to pay workers based on their promised rate. Plaintiff alleges that testimony from third-party witnesses supports his assertion that Butterball.
