Innovative Solutions Internation, Inc., v. Houlihan Trading Co., Inc., et al.

A Seattle federal judge denied Pilgrim’s Pride’s motion to dismiss a case brought against it and another chicken supplier by Innovative Solutions International Inc., the manufacturer of Trader Joe’s Chili Chicken Lime Burgers. The case alleges that the defendant chicken producers misrepresented their chicken as boneless, leading to eventual bones in the Trader Joe’s burgers and necessitating a recall. The judge found that the Plaintiff’s complaint adequately alleged breach of an express warranty that the chicken sold to Plaintiff would be boneless.
