A federal judge has denied the Fish and Wildlife Service’s motion to dismiss a lawsuit by Defenders of Wildlife challenging the agency’s authorization of a commercial harvest of horseshoe crabs in South Carolina’s Cape Romain National Wildlife Refuge. The court further issued a preliminary injunction after determining the plaintiffs are likely to prevail on their claim that the Service violated the Refuge Improvement Act by failing to authorize the commercial horseshoe crab harvesting by special permit.
