ESA Flexibility Act Would Expand ESA Section 4(d) and Reduce Protections for Endangered Species

H.R. 6784, the “ESA Flexibility Act,” would expand Section 4(d) of the Endangered Species Act (ESA) by extending the ability to develop species-specific regulations, currently authorized only for threatened species under Section 4(d), to species listed as endangered. The change would reduce protections for endangered species. The bill was introduced by Representatives Pete Stauber, Dan Newhouse, Cliff Bentz, Harriet Hageman, and Lauren Boebert and has been referred to the House Natural Resources Committee.
