The U.S. District Court for the Southern District of Texas enjoined the Biden administration’s newly-established rule regarding “Waters of the U.S.” (WOTUS) in Texas and Idaho, temporarily preventing the Environmental Protection Agency and the U.S. Army Corps of Engineers from implementing or enforcing the rule in the two states. Plaintiffs argue that the rule, which includes a categorical extension to all interstate waters, regardless of whether they are navigable, violates the plain language of the Clean Water Act. The judge declined to grant a nationwide injunction.
