Michigan Agriculture Trade Groups and CAFOs Challenge State Manure Spray Regulations

The Michigan Farm Bureau, Michigan Milk Producers Association, Michigan Pork Producers Association, Michigan Allied Poultry Industries, Dairy Farmers of America, Select Milk Producers, Inc., and 163 livestock farms sued [pdf attached: Michigan Manure Complaint] the Michigan Department of Environment, Great Lakes, and Energy to challenge new permit conditions for concentrated animal feeding operations. The permit conditions include a prohibition on spraying manure for three months of the year or transferring manure to other entities that spray manure and a restriction on the amount of phosphorous permitted in soil to which manure may be applied. Plaintiffs are seeking declaratory judgment and injunctive relief.
