ENVIRONMENTAL INTEGRITY PROJECT, FOOD & WATER WATCH, GUNPOWDER RIVERKEEPER, LOWER SUSQUEHANNA RIVERKEEPER and PATUXENT RIVERKEEPER v. ANDREW WHEELER, US ENVIRONMENTAL PROTECTION AGENCY, R.D. JAMES and US ARMY CORPS OF ENGINEERS

File
Description

Three new lawsuits brought by two different coalitions of environmental groups and a coalition of Native American tribes challenge the Trump administration’s newest Waters of the United States rule that narrows the scope of the Clean Water Act to exclude many wetlands. The rule excludes wetlands that do not have surface water connections to intermittent or perennial streams, streams that only flow during rainfall or snowmelt, and prior converted cropland. [To accompany Federal Case Law Update "Three New Lawsuits Challenge WOTUS Rule" from Brooks Animal Law Digest Issue No. 37.]
