BC Court Dismisses Lawsuit After Lost Dog Placed with New Family

The British Columbia Small Claims Court dismissed Dale Malkinson's lawsuit against the British Columbia Society for the Prevention of Cruelty to Animals (BC SPCA) regarding her lost dog, Zeva. Zeva went missing on April 10, 2022, and the BC SPCA, unable to identify her owner, listed her for adoption under the name “Delilah.” Zeva was adopted by a new family on May 27, 2022. Ms. Malkinson sought Zeva's return through legal action, but the court determined her rights ended with the new adoption. Citing the Prevention of Cruelty to Animals Act, the court affirmed the BC SPCA's authority to take custody of lost animals and rehome them when owners cannot be located.
